These terms govern access to and use of edgstudios.com. By using the website, you agree to these terms. If you do not agree, please do not use the website.
Operator and website purpose
The website is operated by Eugene David Grey trading as EDG Studios, ABN 46 863 505 932, based in Sydney, New South Wales, Australia. It presents photography, creative production and related services, portfolio material and general information. It is not legal, financial or professional advice for your circumstances.
Website information, enquiries and bookings
We take reasonable care with website information but services, availability, examples, package descriptions, timeframes and indicative pricing may change. Images and case studies illustrate past work and do not guarantee an identical result.
A form submission, email, call, estimate or website price does not by itself create a booking or require either party to proceed. A project is confirmed only when EDG Studios provides written acceptance and any stated deposit, booking fee or other condition has been satisfied. The accepted proposal, estimate, licence or other project-specific agreement takes priority over these website terms if there is an inconsistency.
Intellectual property and permitted use
Unless stated otherwise, the website and its original content are owned by EDG Studios or used under licence or permission. This includes photographs, video, edits, layouts, graphics, copy, branding, downloadable documents and website code. Client names, logos, products and third-party works remain the property of their respective owners.
You may view the website and download a document for your own genuine evaluation of EDG Studios services. Without prior written permission, you must not:
- copy, reproduce, republish, modify, adapt, sell, license, communicate, distribute or commercially exploit website content;
- remove attribution, copyright, watermark or rights-management information;
- use an image, video or document in advertising, editorial, social media, portfolio, merchandising or another public or commercial context;
- scrape, harvest, index or systematically extract content beyond ordinary search-engine indexing; or
- use content to train, fine-tune, test, benchmark or supply a dataset for artificial intelligence, machine-learning or generative systems.
Downloading, viewing or linking to content does not transfer ownership or grant a photography, media, model, artwork, music, trademark or other usage licence.
Portfolio and third-party material
Portfolio material may depict commissioned work, events, products, artworks, premises and identifiable people. Rights in individual components may belong to clients, talent, artists, venues or other parties. You must obtain all permissions required for proposed reuse. EDG Studios does not grant rights on behalf of third parties.
Acceptable use
You must not use the website to break any law, infringe rights, mislead others, facilitate harmful conduct, introduce malware, probe vulnerabilities, disrupt availability, submit unlawful or abusive material, impersonate another person, misrepresent your authority, or use automated access that imposes an unreasonable load or circumvents technical controls.
External links, privacy and availability
Third-party websites, platforms and files are provided for convenience or attribution. EDG Studios does not control and is not responsible for their availability, content, security, privacy practices or terms. A link does not necessarily imply endorsement.
Personal information is handled under the EDG Studios Privacy Policy. We take reasonable care in operating the website but do not promise uninterrupted, error-free or continuously secure access. We may suspend, restrict, change or withdraw content or functionality where reasonably required for maintenance, security, legal compliance or business operations.
Australian Consumer Law and liability
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or another applicable law.
Subject to those non-excludable rights, EDG Studios is not liable for loss caused solely by reliance on general website information, unauthorised third-party use, an external website, or an event outside our reasonable control. To the extent permitted by law, EDG Studios is not liable for indirect or consequential loss that was not reasonably foreseeable. Any liability connected with a paid project is governed by the accepted project-specific agreement and applicable law.
Responsibility for breach
You are responsible for loss directly caused by your unlawful use of the website or material breach of these terms. This does not require you to compensate EDG Studios for loss caused by EDG Studios, does not apply to the extent the loss could reasonably have been avoided, and does not limit a non-excludable right or remedy.
Changes, governing law and contact
We may update these terms where reasonably necessary. The effective date above identifies the current version. If a term is unlawful or unenforceable, it is read down to the minimum extent necessary or severed without affecting the remaining terms.
These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of courts exercising jurisdiction in New South Wales. Questions may be sent to contact@edgstudios.com.
